Yassin Maka

Yassin M. Maka is Head of Litigation at ALN Tanzania and a seasoned dispute resolution lawyer with over 8 years of progressive legal experience in Tanzania. He specialises in commercial litigation, banking and finance disputes, construction and infrastructure disputes, energy and mining litigation, telecommunications and technology disputes, shipping and trade disputes, competition and regulatory disputes, public procurement litigation, and complex employment and family law matters.

Yassin regularly advises multinational corporations, financial institutions, SMEs, logistics companies, investors, and private clients across a broad range of contentious and risk management matters. He has extensive experience representing clients before the Court of Appeal of Tanzania, the High Court of Tanzania (Commercial, Land, Labour and Probate Divisions), subordinate courts, and specialised tribunals and regulatory bodies.

He has acted in high-value debt recovery and enforcement proceedings, EPC/EPCM disputes, procurement appeals, shareholder disputes, marine and cargo claims, land and real estate disputes, labour matters, and regulatory enforcement proceedings. His experience also includes advising clients on litigation strategy, regulatory risk, fraud investigations, and cross-border dispute resolution matters.

Prior to returning to private practice, Yassin served as Group Legal Counsel for Toyota Tanzania Limited and its affiliates, where he led dispute management, coordinated external counsel, advised on regulatory and compliance matters, and managed high-value commercial and employment disputes.

Yassin is an Advocate of the High Court of Tanzania, Notary Public and Commissioner for Oaths. He is also a certified member of the Tanzania Institute of Arbitrators

• Acted for Metito Overseas Limited, an Egyptian multinational company, in complex commercial and arbitration-related disputes arising from project and contractual obligations, including recovery and enforcement of bank guarantees issued in relation to performance bond guarantees and advance payment guarantees; obtaining the lifting of injunctive orders restraining recovery under the relevant bank guarantees, thereby enabling enforcement and recovery actions through the banking institutions; advising on arbitration strategy, preservation of claims, contractual remedies, enforcement risks, and settlement negotiations; and managing disputes involving contractual breaches, enforcement of commercial obligations, recovery strategies, and high-value commercial disputes involving multiple stakeholders and cross-border elements.
• Acted for NCBA in secured asset recovery litigation and debt enforcement proceedings involving defaulted financing arrangements, enforcement of security interests, and contested recovery proceedings before the courts.

• Acted for Kamaka Company Limited, Lodhia Industries Limited, and Total Med Tanzania Limited in shipping and trade disputes involving steel billets cargo claims, bills of lading, cargo misdelivery concerns, marine insurance issues, cargo release protection orders, pre-litigation notices, and claims against shipping lines, carriers, agents, and other stakeholders within the logistics chain.

Insolvency & Restructuring

• Represented Quality Group Ltd in receivership proceedings of Quality Centre Business, including advising on debt restructuring negotiations, enforcement proceedings, insolvency-related disputes, recovery actions against distressed borrowers, and commercial recovery strategies involving financially distressed entities.

Construction, Infrastructure & Procurement

• Acted for Humphrey Constructions Limited and Central Electricals Limited in construction disputes and construction-related claims involving project performance issues, contractual interpretation, payment disputes, delays, variations, and claims arising from construction and infrastructure projects.
• Acted for Total Med Tanzania Limited in procurement review and appeal proceedings before the Public Procurement Appeals Authority (PPAA), including disputes concerning tender awards, procurement compliance, evaluation processes, and administrative decisions made by procuring entities.

Litigation Risk Advisory

• Conducted comprehensive legal due diligence, including litigation due diligence and advisory, for CRDB Bank in relation to a proposed billion-dollar financing transaction involving Mantra Tanzania, a Russian-linked entity, including review and assessment of litigation exposure, contingent liabilities, regulatory compliance, corporate status, contractual obligations, and dispute-related risks to support the bank’s financing and risk assessment process.

• Represented SANLG in connection with a trademark dispute, opposition proceedings, regulatory objections, protection of proprietary rights, and enforcement of intellectual property interests before relevant authorities and tribunals.
