The Central Bank of Kenya (CBK) recently published the National Payment System Bill, 2026 (the Bill), proposing the first overhaul of Kenya’s payments regulatory framework in over a decade. If enacted, the Bill will repeal the current National Payment System Act (Chapter 491A of the Laws of Kenya) and introduce a significantly expanded regulatory regime for payment service providers, payment system operators and other participants in Kenya’s payments ecosystem.

12 October 26

The Bill reflects the rapid evolution of payment services in Kenya and seeks to bring within the regulatory perimeter emerging business models such as payment gateways, card schemes and other payment infrastructure providers. It also introduces enhanced governance, capital, consumer protection and anti-money laundering requirements, while granting the CBK substantially expanded supervisory and enforcement powers.

In this alert, we examine the Bill’s key regulatory changes, their implications for payment service providers and other businesses, and the steps businesses should take to prepare for the proposed framework.
