Dale David Omondi

David is an Associate in the Dispute Resolution team at ALN Kenya | Anjarwalla & Khanna, with a growing practice grounded in international arbitration, commercial litigation (including shareholder disputes), constitutional litigation, employment matters, and tax disputes. He is an Advocate of the High Court of Kenya and a member of the Law Society of Kenya. He holds a Postgraduate Diploma in Law from the Kenya School of Law and a Bachelor of Laws (LL. B) from Strathmore University.

David’s interest in dispute resolution was shaped early through extensive engagement in international arbitration moots, where he continues to serve as an arbitrator. This exposure has strengthened his analytical approach to complex commercial disputes and deepened his understanding of both procedural and substantive aspects of international arbitration.

He is passionate about developing practical, business‑oriented dispute resolution strategies and brings a meticulous, research‑driven mindset to every matter and is keen on contributing to the Firm’s regional and cross‑border disputes practice.

Dispute Resolution

• Acting for ETG, a major agricultural products trader based in Mauritius, in connection with an investment treaty claim against the Republic of Mozambique regarding the seizure of food products. The claim concerns allegations that Mozambican authorities permitted Royal Group Limitada, a local trading company, to unlawfully seize goods valued at USD 60 million from ETG’s warehouses
• Acting for a financial services company operating in the technology and microfinance sector in an arbitration under the LCIA Rules, arising from a failed acquisition of shares following the alleged breach of a share purchase agreement by a microfinance bank.
• Acting for a Middle Eastern financial institution seeking recognition and enforcement of an ICSID award in the United Arab Emirates against an African state entity, which was ordered to pay compensation exceeding USD 1 billion.
• Acting for IIX, portfolio manager of the Women’s Livelihood Bonds (WLBs) — a suite of gender‑lens blended financial instruments supporting women‑focused enterprises across South‑East Asia and Africa — in a constitutional petition filed before the High Court of Kenya by its borrower, Lenana Innovative Solutions Limited. Lenana has defaulted on loan facilities totaling USD 17 million, and despite arbitration clauses designating Singapore as the forum, seeks to invalidate all agreements on constitutional grounds in an effort to circumvent arbitration.
• Acting for a leading markets investment advisor in the settlement of an employment dispute involving a former senior manager.
• Acting for a private client in obtaining a grant of probate in succession proceedings before the High Court of Kenya.
• Acting for Base Titanium, a major mineral sands operator, in defending against a constitutional claim before the High Court concerning alleged violations of environmental rights arising from mining activities in Kwale County, which the petitioner claims affect his land.
