    As a seasoned litigator, Diana has represented clients in disputes involving shareholder issues, mining, employment law, real estate, construction, public procurement, insurance, public law litigation, intellectual property, insolvency, and debt collection. She also represents both local and international clients before various arbitral tribunals and serves on the executive committee of the Lagos Court of Arbitration Network – Young Arbitrators.

    • Acting for Helios and Fairfax in connection with an action commenced by a financial institution in which the financial institution was challenging creditor enforcement rights under term deposit agreements.
    • Acting for Cobham Capital Limited in arbitral proceedings commenced against a warehouse operator seeking enforcement of an irrevocable holding certificate relating to cobalt, including successfully obtaining an award in favour of Cobham and acting for Cobham in registration and enforcement proceedings.
    • Represented Sahara Energy Resources DMCC, a leading supplier of energy products, in a commercial arbitration against the Zambian government for the recovery of debt in excess of USD 700 million.
    • Acting for Intelligent Mobility Solutions Limited in a derivative action launched by Lamise Trading Limited, involving claims of approximately USD 150 million.
    • Representing Silverlands Seed Limited in arbitral proceedings involving share sale and purchase agreements concluded with the late seller who was the majority shareholder of Zambia Seed Company Limited. The estate of the seller disputed the purchase price deferral retained by the Client. The value of the dispute is USD 2,866,994.
    • Acted for Pick N Pay Zambia Limited in arbitral proceedings involving the termination of a lease agreement in which the landlord challenged the termination on the basis that the reasons for termination were not provided for under the lease. The value of the dispute was approximately USD 3 million.
    • Representing TotalEnergies Marketing Zambia Limited in several actions against licensees for breach of Marketing License Agreements

    Mining & Natural Resources

    • Acting for Argonaut in judicial review proceedings relating to the refusal by the Ministry of Mines to lodge Argonaut’s appeal against a decision of the Minister of Mines cancelling Argonaut’s mining license on the ground that the Mining Appeals Tribunal was not operational, including successfully obtaining judgment in favour of Argonaut ordering the operationalisation of the Mining Appeals Tribunal.
    • Acting for Konkola Copper Mines in several actions involving encroachment on the client’s mining areas.

    Construction

    • Representing Kashikoto in connection with a construction adjudication involving a claim worth USD 6.8 million for breach of a Plant and Design Build contract by the contractor.
    • Advised Kashikoto Conservancy Limited in a construction dispute against the contractor arising from a faulty installation of photovoltaic plants.
    • Advised a Chinese State-Owned Enterprise as a contractor on an Engineering Procurement and Construction (EPC) Contract for the construction of Kafue West-Muzuma 330Kv Double Circuit Transmission Lines on behalf of ZESCO Limited for the total value of circa USD 89 million.
    • Advised Velos Enterprises Limited in connection with a contractor’s entitlements against an employer’s breach of the FIDIC Short Form of Contract.

    Employment

    • Acted for the defendant in a class action suit filed by 174 of its former employees seeking damages for breach of contract and payment of gratuity.
    • Assisted Howard University in connection with a dispute with a former employee over termination and reviewed employment contracts and manuals.
    • Acted for the International Centre for Tropical Agriculture (CIAT) and provided various options in respect of a proposed restructuring of employment from WorldFish to CIAT.
    • Representing Pick N Pay Zambia Limited in several employment claims commenced by former expatriate employees whose employment was terminated on the ground that the expatriates had sufficiently transferred skills to Zambian employees who could hold the positions that the expatriates held. The expatriates claimed that they were entitled to permanent employment.

    Pensions & Insurance

    • Acted for FQM Zambia Staff Pension Scheme (FQM) in an action commenced by a former FQM employee for the payment of outstanding pension benefits from the private pension scheme administered by the Client.
    •  Represented a plaintiff in an action commenced against Professional Insurance Corporation Zambia PLC for a House Owners Insurance Claim in the Lusaka High Court.
    •  Assisted American Institute for Research with amicably resolving a matter with the National Pensions Scheme Authority (NAPSA) involving unpaid obligations to NAPSA for approximately 82 employees.
    •  Acted for Sandvik Mining and Construction Zambia Limited in arbitral proceedings related to a subrogation claim by an insurance company against our Client.

    Intellectual Property

    • Advising GoCongo in connection with registration of trademarks in Zambia and representing GoCongo in an appeal challenging the refusal by the Patents and Companies Registration Agency to register certain trademarks.
    •  Acted for Zambia Tourism Agency as the defendant in an action commenced against our client for a claim for copyright infringement.
