The Settlement Framework – An Overview of its Application in Practice

At an awareness session on the Settlement Procedure conducted by the Financial Services Commission (the “Commission”) on the 12 April 2022, the Chief Executive of the Commission stressed that the Settlement Committee is not a ‘whitewashing’ instance and that settlement discussions might take place in parallel with any investigation, inquiry or referral to the Enforcement Committee which have already started.

Finance (Miscellaneous Provisions) Act 2022

On 29 July 2022, the Mauritian Parliament passed the Finance (Miscellaneous) Provisions Act 2022 (the “FA 2022”), which enacts into law the measures announced by the Honourable Minister of Finance in the Budget Speech 2022-2023.

 

EACJ Issues Landmark Decision in Kenyan Election Dispute

The East African Court of Justice (EACJ) Appellate Division issued a landmark decision affirming an earlier ruling by the First Instance Division to find that Kenya, through the Supreme Court of Kenya, infringed on Martha Karua’s (Ms Karua) right of access to justice. It is the first time the EACJ Appellate division has determined election-related disputes arising from a decision (s) of the Supreme Court of Kenya (Petition No. 3 of 2019).

 

NCC Approved and Published Updated Requirements for Individual Licence Application

On 6 June 2022, the Nigerian Communications Commission (the NCC) released an updated requirements for Individual Licence application. The NCC has approved the additional requirements in furtherance of its mandate as enshrined in the Nigerian Communications Act (NCA) 2003. While some of the requirements remain the same, some additions and amendments are noticeable.

Data Protection Registration Law Comes into Force on 14 July 2022

From 14 July 2022, the provisions of the Data Protection (Registration of Data Controllers and Data Processors) Regulations, 2021 (the Regulations) will come into force and the process of registration with the Office of the Data Protection Commissioner (the ODPC) will also begin for data controllers and data processors.

Changes to AVTS and VAS Application Requirements

As part of the updates and changes to the NCC requirements for an Individual License, the NCC updated the requirements for application for an Individual License to operate Automated Vehicle Tracking Service (AVTS) and VAS (Content Service using Short Code).

The African Union (AU) is commemorating African Integration Day in a two-day event in Lusaka, Zambia between 6 and 8 July 2022 exploring the e-commerce potential of the Single African Market.
