Daniel Ngumy has been with the firm for 14 years. He has also been extensively involved in the development of tax policy in Kenya.

Rosa Nduati- Mutero is a Partner in the Corporate and M&A practice and also specialises in corporate governance and employment law. In her 19 years with ALN Kenya, Rosa has worked with many of the Firm’s most prominent clients on landmark M&A and capital markets transactions across the continent.  Rosa has also led the firm’s CSR initiatives for several years and serves on the pro bono committee.

The transition in leadership is part of an overall change in the governance of the Firm, which will now have a Partnership Board and an Executive Committee. Turning the Tide on Plastic Pollution by Harmonising Regional Regulations

ALN Kenya together with The Flipflopi Project and Sustainable Inclusive Business have launched, on 10 February 2022, a report uncovering the need to adopt streamlined legislation to manage plastic pollution throughout the East African Community (EAC).

The report, titled ‘East Africans: Let’s Unite for Change’, aims to promote a better understanding of existing Single-Use Plastics (SUPs) regulations and lay the groundwork for the adoption of streamlined legislation and collaborative action within the EAC to regulate plastics production, support waste management, and eliminate unnecessary SUPs at a regional level. The report outlines the current state of affairs of the policies, regulations, and laws that address the harmful effects of SUPs in East Africa.

The goal of the report is to promote a better understanding of existing Single-Use Plastics (SUPs) regulations and lay the groundwork for the adoption of streamlined legislation and collaborative action within the EAC to regulate plastics production, support waste management, and eliminate unnecessary SUPs at a regional level. The report outlines the current state of affairs of the policies, regulations, and laws that address the harmful effects of SUPs in East Africa.

The report highlights the existing efforts the EAC has taken to combat plastic pollution and is timely in its release as it comes before the fifth session of the United Nations Environment Assembly (UNEA 5.2). The assembly held in Nairobi from February 28th to March 3rd, 2022 provides a unique opportunity for governments to commit to the establishment of a UN global treaty on plastic pollution that the world has been calling for.

“The report explores the policies and regulations focused on protecting the environment or managing SUPs across Kenya, Rwanda, Burundi, South Sudan, Tanzania, and Uganda, and aims to support increased understanding of the existing regulations, which would provide a foundation for aligned legislation at a regional level.” Noted Davina Ngei, from the Flipflopi, adding that “the issues examined include the adopted legislative and regulatory frameworks within the EAC, the progression of laws across each country, the successes, challenges, the lessons learned, and an overview of other regional and global regulations and treaties.”

Plastic pollution is a major growing problem for the global environment. According to IUCN, 300 million tonnes of plastic waste is produced annually, with half of the plastic products designed for single use. Across East Africa, there are notable efforts to tackle the single-use plastic scourge with strong legislation in place, like in Rwanda and Kenya. Despite this, single-use plastic production and disposal continue to grow rapidly fueled by the covid-19 pandemic. In Kenya for instance, only 27% of the plastic waste generated is collected: 8% collected for recycling and the remaining 19% disposed of in unsanitary landfills or dumpsites.

While data on the extent of plastic pollution on the African continent is still limited, a large number of African countries (34 out of 54) have passed legislation prohibiting the use of certain SUPs, with varying degrees of implementation. However, while legislation and implementation are spotty, the report highlights the need for binding legislation and cooperation to tackle the global plastic pollution crisis. 

To combat this, ALN Kenya has partnered with Flipflopi to champion the legislative agenda at an EAC level through the drafting and introduction of a legislative framework to ban the use and manufacture of specific single-use plastics in the EAC to be presented before the EAC Legislative Assembly for consideration. 

“The indiscriminate pollution of our oceans which threaten food chains and ocean and lake-based communities should be of grave concern to legislators. There is a need to take immediate action towards harmonising policies to ensure we successfully tackle plastic pollution in the region,” said Karim Anjarwalla, Managing Partner ALN Kenya | Anjarwalla & Khanna.

As the EAC economies grow, we are offered a range of opportunities to rethink single-use plastics and recycling. We’re in a position to develop new production, consumption, and disposal models that are focused around a closed-loop model. This model takes us away from the current consumption and destruction model and can promote community-led closed-loop waste management initiatives to tackle this global issue at a local level while creating new industries and employment opportunities.

“To address plastic waste pollution at source, we need to fundamentally rethink the way we design, use and reuse plastics. The Kenya Plastics Pact, for instance, brings together stakeholders from across the whole plastics value chain to transform the current linear plastics system into a circular economy for plastics which keeps them in use and out of the environment. It is now more relevant than ever to build collective solutions adapted to our region’s reality,” said Karin Boomsma, Sustainable Inclusive Business Project Director.

“Increasing policy frameworks that support more conscious economies while promoting a just transition – in which policies stimulate economic opportunities relating to single-use plastics alternatives; protect livelihoods; and ensure inclusive representation in the policy-making process – is critical. Now is the time for East Africa to build on the momentum of member states, and the UN treaty, raise the bar in the EAC, draw lessons and best practices from around the world, and come together to outline bold and inspired measures that benefit the health, wellness, and livelihoods of all East Africans,” the report concludes.

“Tanzania and other EAC member states have individually made strides towards addressing the negative effects of single-use plastic. There is an opportunity to change the tide on plastic pollution from a regional level by taking a stand as environmental leaders tackling single-use plastic and with that spur global action and consensus,” said ALN Tanzania Partner, Shemane Amin.

Leadership and Change: The Law Firm of the Future

Often, leaders at law firms are determined based on their success as legal practitioners. However, what makes a successful legal practitioner might not necessarily be what makes a good leader, especially in terms of change and change management.

Leaders at law firms need to recognise that change as a thing in an organisation is a very difficult process that needs attention and knowledge. Change in an organisation fundamentally operates on emotion and not rationality. When driving change in an organisation, one is not dealing with a rational set of circumstances but with lots of emotion, different individuals, egos and talent. Change in law firms must be effected in individuals and not in products and this is very different. A leader must recognise that emotions impact people and cause them to react irrationally to rational change because change will not happen unless leaders address the emotional aspect of the change being implemented. Leaders need to train themselves or be trained in managing emotions in the law firm.

Taking Action to Drive Change
Driving change is not about making policies or processes but rather about conscious actions to implement the change. There are two aspects to taking action to drive change, which leaders must understand. First, is putting programs and policies that allow flexibility and demonstrating a commitment to implementing those programs/policies. Secondly, the hard part of listening carefully to what the employees in the law firm are saying – leaders should not assume that they know what is bothering their employees/what the employees want. In dealing with women, junior lawyers or other teams within the law firm like the finance team, tech team, business team etc, leaders should not make assumptions but ask questions and listen carefully to everyone’s view.

Part of a leader’s job is to be curious about what is happening around them, about what junior lawyers and other staff are doing and thinking and creating an enabling environment within the law firm that allows for different individuals within the firm that have skills or ideas to be identified and given opportunities to act on their ideas.

Adopting A Growth Mindset
Leaders and everyone else in the law firm must adopt a growth mindset as opposed to a fixed mindset: a fixed mindset is fixated on things they know and do well in while a growth mindset is happy to not know things and to try them and fail. The vast majority of lawyers have fixed mindsets and this in part is because of the training lawyers undergo which makes us believe that being right is the goal. However, while being right is good for providing legal services, it is a disaster for advancing change. Projects that have failed should not be used as a reason to not try something again but as a lesson – the more failures you have the better you are doing in advancing change and innovation. A leader that advances change, is curious and not afraid to fail.

The Client of the Future
The pandemic has introduced a new normal and has changed the way businesses and law firms operate. Clients are under immense pressure to stay afloat and as such they require emotional and personal support over and above the legal support that we typically provide as lawyers. Many times, when clients approach law firms, not only are they under pressure to deal with the legal problem at hand, but they are also under immense emotional pressure that is associated with the problem. It is therefore important for lawyers to also take interest in the client’s well-being; and once a client feels safe with you, they will always see you are their trusted advisor and friend. Effectively, questions relating to pricing or billing will fall into place as things will come secondary as the client perceives you as a trusted advisor and will stick with you.

There has been an exponential growth of technology within the legal space, particularly with the advent of mobile applications and artificial intelligence software programmes, which are been seen to replicate some of the roles and work that would ordinarily have been done by lawyers, for example, due diligence and contract review software. Rather than trying to compete with the various technology service providers, lawyers will need to identify ways in which it can tap into the various technology segments to advance its already existing service offerings.
